Right of withdrawal
Consumers within the meaning of the KSchG have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which the customer, or a third party designated by the customer who is not the carrier, has taken possession of the goods.
To exercise the right of withdrawal, the customer must inform WILDKRAUT of their decision to withdraw from the contract by means of a clear statement (letter sent by post, fax, or e-mail). The customer may use the attached model withdrawal form for this purpose (section 13). Preferably, the withdrawal declaration should be sent by e-mail to office@energysniff.com.
To meet the withdrawal deadline, it is sufficient for the customer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.
The right of withdrawal does not apply to packaging that has already been opened, nor to goods made to customer specifications, goods clearly tailored to personal needs, goods that by their nature are not suitable for return, goods that may spoil quickly, or goods whose expiry date has passed (§ 18 para. 1 FAGG).
Consequences of withdrawal
If the customer withdraws from the contract, WILDKRAUT must reimburse the customer for all payments received by WILDKRAUT that are attributable to the relevant contract, without undue delay and no later than fourteen days from the day on which WILDKRAUT received notification of the withdrawal from the contract. This also includes delivery costs paid by the customer to WILDKRAUT. Excluded are any additional costs resulting from the customer choosing a type of delivery other than the least expensive standard delivery offered by WILDKRAUT (e.g. express delivery).
However, WILDKRAUT may refuse reimbursement until WILDKRAUT has received the goods back in proper condition or until the customer has provided proof that the goods have been returned.
For the reimbursement, WILDKRAUT will use the same payment method that the customer used for the original transaction. WILDKRAUT may also use a different payment method, provided that this does not result in any costs for the customer.
The customer must return the goods to WILDKRAUT without undue delay and in any event no later than fourteen days from the day on which the customer informed WILDKRAUT of the withdrawal from the contract. The goods must be sent to the address stated in the General Terms and Conditions, section 13 “Withdrawal form”. The deadline is met if the customer sends the goods before the fourteen-day period has expired. The customer bears the cost of returning the goods.
